Website Template Terms and Policies
Thank you for considering my templates. By purchasing any of Alubia Design’s template materials, you agree to the following terms and conditions.
I may update or modify these Terms of Service at any time, and without prior notice to you. Any changes will be effective immediately upon posting the updated Terms on our website, and the most current version will supersede all previous versions. It is your responsibility to review the Terms regularly to stay informed of any updates or changes. Your continued use of my products and services after any changes to the Terms indicate your acceptance of the updated Terms.

Definitions:
"I," "ME," AND "MY"
refer to Alubia Design and, or, Kumika Yamawaki.
"YOU", "USER," "CUSTOMER," OR "CLIENT"
refers to the user or any person who uses my Service or purchases my products.
"INSTALLED"
refers to the point at when you receive an invitation or site permission request or when you have been provided access to any of the purchased materials.
"SQUARESPACE TEMPLATE"
refers to a pre-designed layout that serves as a starting point for designing a Squarespace website. The template provides a framework for the website's design, including elements such as fonts, colors, and page layout. The template provides a structure for organizing and presenting content on the website.
Squarespace Template:
By purchasing my template, you'll receive a thoughtfully designed layout, font selection, and color scheme that you can apply to your Squarespace website. It's important to note that while the template enhances the visual elements of your site, the functionality and features are still provided by Squarespace.
If you require specific functionality or features beyond what is included in the template, you may need to add them through Squarespace's existing features or third-party integrations. Squarespace offers extensive documentation and support resources that you can utilize, and I recommend reviewing Squarespace's documentation and support resources to better understand the platform's capabilities and limitations.
Template Installation:
To transfer a Squarespace template to you as a new website, please note that you must have a Squarespace account. If you do not have an account, you can create one after receiving an invitation.
Once you have placed an order or purchased a template, I will transfer a new Squarespace website into your account within 48 hours. You will receive a website permission invitation from Squarespace to your provided email address, which you will need to accept to access your new site. Additionally, you will receive a second email from kumika@alubiadesign.com containing a PDF guide with instructions on how to customize the key features of the template. Please ensure that you provide the correct email address, as I cannot be held responsible for any issues caused by incorrectly submitted information.
Please ensure to check the linked demo site carefully on the relevant ETSY listing page and on www.alubiadesign.com, as the pages in the template will appear exactly as they do, except for any images, which will be replaced with generic placeholders. You will need to add your own content, text, images, and other brand elements to the template pages.
Please make sure to check your email inbox (including spam folder) for the invitation from Squarespace within 48 hours of purchasing the template. In case you haven't received the invitation within this timeframe, please notify me by email so that I can resend it. If you fail to accept the invitation or request a new one within 30 days of purchase, I will consider the design delivered, and you will no longer be entitled to a refund or a new invitation. Please note that you are solely responsible for ensuring timely access to the template.

-Adding your content
-Search Engine Optimisation

-Migration or Integrations of any sort (content, social media, domains etc.)
-Graphic design services
-Copywriting or content creation
-E-commerce setup or configuration
-Payment setup or configuration
-Email marketing setup or configuration
-Custom coding beyond the scope of the template
-Ongoing website maintenance or support
-More than 30 days of email support
What You Will Receive:
When you purchase one of my templates, I will recreate the demo template exactly as it appears on the corresponding ETSY listing page and/or www.alubiadesign.com. Please note that any images used in the demo template are not included, as they remain the copyright of the original stock image websites.
Please note that the demo template may include custom CSS or JavaScript code that is not part of the standard Squarespace platform. I do not provide support for custom code or customizations beyond the scope of the template. If you require additional customization or support, I would be happy to provide a quote for additional website design services.
Installation Timeline:
I understand that receiving your template installation promptly is important to you. I will make every effort to install your template within 48 hours, excluding the day of purchase, weekends, or holidays listed on my ETSY shop announcement. However, in some rare cases, installation may take longer, and I will inform you of any delays.
Please note that the order time and date are based on GMT+2 time, not client’s local time.
When you purchase my templates, you agree to accept the installation timeframe as communicated and will notify me promptly if any concerns or issues arise. While I always strive to meet the 48-hour installation timeframe, I cannot be held responsible for any issues that arise due to factors beyond my control.
Copyright:
The Squarespace website templates created by Alubia design are protected under copyright law. The template is intended for sale exclusively by Alubia design and may not be copied, distributed, or used for any purpose other than to create a website for personal or commercial use by the purchaser.
Please note that any photographs used in the templates are for illustrative purposes only and the copyright belongs to their original creators. Your template will be installed with placeholder images rather than the photographs used in the demo. It is strictly prohibited to use photographs from the demo sites for any live website.
I reserve the right to use your finished website design in promotional material, including template showcases, for the purposes of demonstrating and marketing my products. However, I will not disclose any confidential information or personal data without obtaining your explicit consent beforehand.
Using Templates For Clients:
When purchasing a Squarespace template from Alubia design for use in a client project or any project where compensation is received, it is important to note that you cannot claim the template as your own original work and you must place a credit to Alubia design with a live hyperlink to my website www.alubiadesign.com. Proper credit must be given to me to avoid breaching copyright.
Template Updates:
I strive to provide my customers with high-quality templates that meet their needs. However, please be advised that once you purchase a template design from me, it is sold as-is. I am not obliged to reinstall the template if a newer version or design is released, and I cannot guarantee lifetime updates to the content if the template has been retired or removed from the store, or if it will no longer be updated.
I encourage my customers to stay informed about any updates or changes to the templates they have purchased. Additionally, I am always available to answer any questions you may have about my templates or their usage.
Responsibility for Template:
Maintenance:
After the template has been installed, it is considered completed and fulfilled from my end. It is your responsibility to maintain your website and the template moving forward. I am not responsible for any issues that arise from neglect, misuse, or misconfiguration of the template after installation.
I recommend that you regularly update and maintain your website to ensure that it is functioning correctly and is secure. Additionally, I suggest that you keep a backup of your website in case of any unforeseen events.
Trial site:
It is your responsibility to upgrade your trial site with Squarespace within the trial period. If you allow your free trial to expire, you must reactivate your site with Squarespace. Please note that if your trial has lapsed, I will not issue you a new website template. In such cases, you will need to re-purchase the template and installation services. I highly recommend that you upgrade your trial site to a paid subscription before it expires to ensure that you have continued access to your website and its features.
Customization:
It is your responsibility to customize the template to suit your specific needs after it has been installed. Alubia design is not responsible for any changes, customizations, or additions made to the template after installation. I am not obliged to reinstall the template if you make any changes or deletions to the content or styles. It is your responsibility to maintain the template and make any necessary updates or changes.
I recommend that you take the time to carefully review the template and make any customizations before making your website live.
Account:
You are solely responsible for all costs associated with your Squarespace account, including but not limited to domains, hosting, monthly plans, annual plans, email accounts, and any other services provided by Squarespace.
I am not responsible for any charges or fees incurred as a result of your use of Squarespace services. It is your responsibility to manage and maintain your Squarespace account, including keeping your billing information up to date and renewing your subscriptions as needed.
If you require any assistance or have any questions related to your Squarespace account, we recommend that you contact Squarespace's support team directly. I am here to support you with any template-related inquiries, but we cannot assist you with Squarespace account management or billing issues.
I am not responsible for any costs or fees incurred as a result of your Squarespace account, including payment or billing issues. I cannot be held liable for any interruptions or issues with your website that may arise due to payment or billing issues with Squarespace.
Email Support:
Each template purchase entitles you to 30 days of template-related email support from the day you receive your template. During this time, I can provide assistance related to the customisation of the pre-designed layout and design elements included in the template. This may include guidance on how to modify and adjust the template's design to suit your specific needs, such as adjusting font sizes or changing colours.
It's important to note that my support is limited to template-related issues, and I cannot provide assistance with issues related to the underlying functionality of your website or the Squarespace platform. If you encounter any issues related to Squarespace's platform, I recommend that you contact their support team directly for assistance.
After the 30-day support period has ended, I am available to provide additional support and customisation services on a fee basis. Please don't hesitate to reach out if you require further assistance beyond the initial 30-day period.
Support does not include:
-Anything unrelated to the Template
-Squarespace Tutorials
-Custom coding beyond the scope of the template
-Copywriting or content advice or services
-Software, IT and programing problems
-Hosting, domains, email, social media
-Design advice or services
-Coding questions
- Re-installation
-Website maintenance
UPDATE BY SQUAREPSPACE:
Please note that the Squarespace platform may change or update at any time, and this is beyond my control. While I strive to ensure that my templates are compatible with the latest version of Squarespace at the time of purchase, I cannot guarantee that they will be compatible with future updates.
I am not obligated to provide support for older templates built on outdated versions of Squarespace. If you encounter issues with your template after a Squarespace update, I recommend that you contact Squarespace support directly for assistance.
License:
Purchasing this template allows you to use it for ONE website only in your own Squarespace account (1 Squarespace template purchase = 1 website)
It cannot be resold or duplicated.
Intellectual Property Rights:
You may not violate my intellectual property rights, including copyright and trademark, as specified above.
Template Access:
I reserve the right to discontinue my templates and any included materials at any time in the future, for any reason. While I make every effort to ensure that my templates are available for purchase at all times, I cannot guarantee that they will be available indefinitely.
If I decide to modify any existing resources or templates in the future, you agree that I am not obligated to provide you with that separate offering for free or at a discount.
Requirements:
It is your responsibility to check each template linked demo site and description carefully for specific requirements.
All templates require a Squarespace account to be installed and a Squarespace business subscription or higher. Please do not purchase a Squarespace plan until after you receive your website invite as I install the site as a BRAND NEW site.
Having a basic understanding of Squarespace editing and the internet in general is needed. It is your responsibility to ensure that you have the necessary skills and knowledge to use Squarespace and my templates effectively.
Compatibility issues and malfunctions:
Please note that updates to Squarespace or other third-party services may affect the functionality of my templates, plugins, or code. In such cases, I am not obligated to update your templates or inform you about any potential issues.
Additionally, I cannot guarantee that my code, plugins, or templates will be compatible with any existing customizations, integrations, or other code or plugins on your website. I also cannot guarantee compatibility with any future revisions, updates, or versions of Squarespace or other third-party services. I recommend regularly reviewing and testing your website to ensure everything is functioning as intended, and contacting me if you have any questions or concerns.
Custom Code and Third-Party Applications:
I want to ensure that your website functions smoothly and efficiently. However, please note that I cannot guarantee the compatibility of my custom code with any other code, plugins, customizations, or integrations that you may have already installed on your website.
Furthermore, I cannot assure you that my custom code will function flawlessly with any future updates, revisions, or versions of Squarespace or other third-party services. This is because I cannot control any changes that these services may make or any customizations that you may implement on your website. As a result, my custom code may require additional modifications or updates to maintain compatibility with the latest technologies and updates.
Please note that any issues that arise due to incompatibility or errors caused by custom code that I have developed for your site may require additional services from me to resolve. In such cases, I will work with you to identify the cause of the issue and provide a quote for the required services to fix it.
As browser technology and web applications evolve over time, I cannot guarantee that embedded third-party applications or custom code will continue to function as intended after I complete my installation service. While I take every effort to ensure that my work meets the latest technical standards and guidelines, unforeseen changes in Squarespace, third-party applications, or web browser technology could result in issues with your website.
In the unlikely event that your website is affected by any changes that break its functionality, I will be happy to provide an estimate for resolving the issue at that time. Additional charges may apply for these services, but I will keep you informed every step of the way.
Refunds & Cancellation:
Due to the digital nature of the website template, all sales are final, and refunds nor exchanges of any kind will be issued.
Please ensure to check the linked demo site as well as information carefully on the relevant ETSY listing page and on www.alubiadesign.com before making a purchase.
This will enable you to determine whether the template is suitable for your needs and whether you can use it efficiently.
Please note that I retain the right to cancel an installation at any time. If I do so, I will only refund the full amount of the Install service. I will make every effort to inform you promptly in the event of cancellation.
Multi Browser Compatibility:
I test my templates and code on a variety of modern web browsers. However, it is not feasible for me to test every browser or every version of every browser. As a result, some features of my templates and code may not function properly if a particular browser lacks the necessary capabilities to feature the code.
I cannot be held responsible for any issues that arise due to unsupported code or features across different browsers.
For the best possible user experience, I recommend using the latest version of a modern web browser, such as Chrome or Safari. This ensures that you can take full advantage of all the features and capabilities of my templates and code, as well as benefit from the latest security updates and performance enhancements.
Business Performance Disclaimer:
I cannot make any guarantees, either explicit or implicit, regarding the level of earnings or income that you may achieve using my website templates, information, or educational materials. These resources are designed to support you in reaching your business goals and objectives, but your success ultimately depends on your own experience, motivation, and individual abilities.
By using my website templates, information, and education, you acknowledge and agree that any earnings or income that you may generate are solely your responsibility and are dependent on a variety of factors, including but not limited to market conditions, economic trends, and individual effort.
